Abstract

The regulation of former convicts' political rights in legislative candidacy in Indonesia lies in tension between the human right to stand for election and the public interest in having representatives of integrity. This tension is compounded by a series of Constitutional Court decisions on the five-year waiting period, which have repeatedly re-interpreted statutory norms and required adjustments to General Elections Commission (KPU) regulations. This article analyzes the regulation and dynamics of these rights and formulates a reconstruction. It uses normative juridical research with statutory, case, and conceptual approaches. The findings show that the operative norm is scattered across separate court decisions for each type of office, the starting point of the waiting period is not aligned with the additional penalty of revocation of rights, and the benchmark of a criminal threat of five years or more does not differentiate the gravity of offences. The article concludes that candidacy requirements should be codified in a unified statute, the starting point of the waiting period clarified, and the additional penalty of revocation of the right to be elected, imposed individually and for a limited time by judges, optimized.
